Florida Wrongful Death Lawyers at Emerson Straw

Losing someone you love because of another person’s negligence is devastating. Alongside the grief, families are often left with unanswered questions about what happened, who is responsible, and how they will manage without their loved one’s income and support. Florida law gives families a way to seek accountability and financial stability after a preventable death.

At Emerson Straw, we have built a reputation for our tenacity and refusal to back down in the face of injustice. Our wrongful death attorneys represent families throughout Florida in claims arising from fatal car and truck accidents, motorcycle, bicycle, and pedestrian accidents, medical malpractice, nursing home neglect, defective products, and dangerous property conditions.

Under Florida’s Wrongful Death Act, a claim is brought by the personal representative of the deceased person’s estate on behalf of the surviving family members and the estate. We can explain how the process works, help identify who may be entitled to recover, and handle the investigation and legal work so your family can focus on one another.

If you have lost a loved one in Florida, contact Emerson Straw to schedule a free consultation. We’ll listen to what happened, answer your questions, and help you understand your family’s options, with no attorney fees unless we recover compensation.

The death of a family member is overwhelming, and when it was caused by someone else’s negligence, the pain can be compounded by anger, confusion, and financial uncertainty. In some cases, punitive damages may also be available.

    Frequently Asked Questions

In Florida, a wrongful death claim is filed by the personal representative of the deceased person's estate, on behalf of the surviving family members and the estate. Survivors who may recover include the spouse, children, and parents, and in some cases other blood relatives or adoptive siblings who depended on the deceased for support or services.

In most cases, a wrongful death claim must be filed within two years of the date of death. Different rules apply to some cases, such as deaths caused by medical malpractice or claims against a government agency, which have their own deadlines and notice requirements. Because missing a deadline can prevent your family from recovering anything, it's important to speak with an attorney as soon as you're able.

Surviving family members may recover the value of lost support and services, loss of companionship and guidance, and, for certain family members, mental pain and suffering. The estate may recover the deceased person's lost earnings, expected savings, and medical and funeral expenses it paid. Some limits apply in medical malpractice cases, particularly for adult children and parents of adult children, so the damages available depend on the circumstances.

Florida uses a modified comparative negligence rule. In most cases, if your loved one is found 50% or less at fault, the family's compensation is reduced by that percentage. If they are found more than 50% at fault, the family may not be able to recover. Insurers sometimes try to shift blame onto the person who died, so a thorough investigation matters.
